The reasoning behind this is that the state has the right to tell businesses not to discriminate on terms defined by the state because businesses have transaction tax privileges (business licenses) from the state and counties. In turn people are forced to obtain business licenses in order to legally conduct business.

When did people lose the freedom to do commerce without a business license?

If the state keeps up this kind of nonsense the obvious incentive is to conduct commerce without a business license and to collect no sales taxes (which is what a transaction tax privilege license is all about). In short: go dark, economically speaking.

In June, the Supreme Court decided the case Masterpiece Cakeshop v. Colorado Civil Rights Commission, issuing a powerful rebuke to the Colorado Civil Rights Commission for its "religious hostility" toward Christian baker Jack Phillips. Phillips had refused to bake a cake for a same-sex wedding, and the commission had compared his decision to religious arguments in favor of the Ku Klux Klan and Nazism.

Now, the commission is again going after Phillips for declining to create a custom cake — this time a cake celebrating transgenderism. On Tuesday night, Alliance Defending Freedom (ADF), the Christian law firm that represented Phillips before the Supreme Court and helped him gain an important 7-2 victory, filed a federal lawsuit against the commission to forestall action against Phillips.

"The state of Colorado is ignoring the message of the U.S. Supreme Court by continuing to single out Jack for punishment and to exhibit hostility toward his religious beliefs," ADF Senior Vice President of U.S. Legal Division Kristen Waggoner declared in a statement. “Even though Jack serves all customers and simply declines to create custom cakes that express messages or celebrate events in violation of his deeply held beliefs, the government is intent on destroying him—something the Supreme Court has already told it not to do."

What kind of cake "celebrates transgenderism"?

Does it has an appendage that sticks out and then it is ceremoniously cut off?

That is a terrible thing to be going after the guy again after a 7-2 smackdown by SCOTUS. His legal team needs to bring actions against his tormentors personally.

She asked for the cake on the same day the U.S. Supreme Court announced it would consider Phillips' appeal of the previous commission ruling against him. In that 2012 case, he refused to make a wedding cake for same-sex couple Charlie Craig and

The Supreme Court ruled in June that the Colorado commission showed anti-religious bias when it sanctioned Phillips for refusing to make the cake, voting 7-2 that it violated Phillips' First Amendment rights.

But the court did not rule on the larger issue of whether businesses can invoke religious objections to refuse service to gays and lesbians.

Phillips' lawsuit alleges that Colorado violated his First Amendment right to practice his faith and 14th Amendment right to equal protection. It seeks $100,000 in punitive damages from Aubrey Elenis, director of the Colorado Civil Rights Division.

Attorney General Cynthia Coffman says the case should be dismissed because of state efforts to enforce its order against Phillips. A state hearing is scheduled for February to determine what will happen next.

Deputy Attorney General LeeAnn Morrill told Senior Judge Wiley Y. Daniel that the commission did not mention religion in its latest finding against Phillips. She said the commission also has used the state's anti-discrimination law to protect people who have faced bias because of their faith.

The judge said he thought the Supreme Court's ruling had more relevance in the current case than the state acknowledged and quoted from the justices' opinions during the hearing. He mentioned now-retired Justice Anthony Kennedy's conclusion that the commission had shown "hostility" toward religion.

Wiley said he would have to hear evidence before deciding whether to temporarily block state proceedings.

In the lawsuit, Phillips' attorneys say he "believes as a matter of religious conviction that sex — the status of being male or female — is given by God, is biologically determined, is not determined by perceptions or feelings, and cannot be chosen or changed."

It claims Phillips has been harassed and received death threats and that his small shop was vandalized while the wedding cake case made its way through the courts.

Not only is the State of Colorado targeting him, all manner of angry people are lined up to order a cake for the cynical purpose of bringing a lawsuit against him. There is also obvious coordination.
