House lawmakers sent a letter to U.S. Virgin Islands Gov. Kenneth Mapp demanding answers on an ammo and firearm seizure he authorized in the days leading up to 2017's Hurricane Irma.

House Natural Resources Committee Chairman Rob Bishop, R-Utah, and House Judiciary Committee Chairman Bob Goodlatte, R-Va., wrote to Mapp seeking answers to questions they had regarding his executive order authorizing the seizure, which the lawmakers note is "still in effect today."

The order allows the adjutant general to "seize arms, ammunition explosives, and incendiary material" and effectively authorizes the "National Guard to seize lawfully owned firearms from citizens, in clear violation of their constitutional rights."

Bishop appeared on Fox News' "Tucker Carlson Tonight" on Wednesday to explain the "clarification" the chairmen hope to seek.

The letter sets a deadline of 5:00 pm on Aug. 1, 2018, for Mapp to provide the following information:

As further information, Snopes looked into this and ruled the allegation that "Did the Governor of the United States’ Virgin Islands Sign an Order Allowing the Seizure of Weapons During Hurricane Irma?" as TRUE.

The US Virgin Islands are US territory. The inhabitants of the US Virgin Islands were granted citizenship in 1927, so I would presume that the Bill of Rights and other constitutional rights extend to those citizens.

In the Tucker Carlson piece it was mentioned that the NG has not actually seized anyone's firearms, but the governor's order stands. In fact, it has been repeatedly renewed.

A legal issue or NG refusing the orders? Maybe authorizes but doesn't order.

I'm not an attorney but I would hope that the governor's order alone (regardless of whether the USVI NG acted on it) would be unconstitutional.

IIRC, after Hurricane Katrina, either the Louisiana Governor or the Mayor of New Orleans order the confiscation of people's firearms and that was ruled unconstitutional.

Some party with "standing" has to bring the case. If there is yet no seizure, there may be nobody with standing.

Having to prepare to repel boarders might be a "hardship" ??

Yes, it would, but this is the Federal court system and there hasn't been an armed insurrection in quite some time. ;)

Sounds like the Adjutant General is not only authorized to seize firearms, ammunition and explosives ... but any other property required by the military to perform their duties !
