Illegal immigrant victim’s mother: ‘We are at war right here in this country’

By Stephen Dinan - The Washington Times - Tuesday, July 21, 2015

Choking back tears, parents and wives whose relatives were killed by illegal immigrants pleaded with Congress Tuesday to begin to enforce immigration laws, saying that but for bad federal policies and sanctuary cities, their relatives would still be alive.

“I want you to be angry that America’s borders are wide open,” said Laura Wilkerson, mother of 18-year-old Josh Wilkerson, who was killed by an illegal immigrant acquaintance in 2010. “Realize that we are at war right here in this country.”

The heart-rending stories put a different face on an issue that’s often seen through the eyes of sympathetic illegal immigrants. But spurred by the July 1 murder of Kathryn Steinle in San Francisco, victims’ families are increasingly stepping forward and demanding they have a voice in the conversation.

Ms. Steinle’s father, Jim, who was walking with her on a pier at the time she was shot and killed, allegedly by a five-times deported illegal immigrant who was being protected by by San Francisco’s sanctuary policy, told the Senate Judiciary Committee his daughter was the victim of “unjointed laws and basic incompetence of the government.”

Steinle’s murder has prompted a rethink of the federal government’s tolerance of sanctuary policies. House Republicans have already scheduled a vote for later this week to punish sanctuary cities such as San Francisco that refuse to cooperate with federal immigration authorities.

Sen. Dianne Feinstein, a California Democrat who served as major of San Francisco for 10 years in the 1970s and 1980s, called on the city to rescind its sanctuary policy and agree to cooperate when federal immigration authorities ask to be notified that an illegal immigrant is about to be released. Currently, San Francisco refuses to even tell officials the date and time an illegal immigrant would be released, with the intent to stymy agents’ efforts to be on hand to pick up the illegal immigrants.

The Homeland Security Department says it wants cooperation from cities, but officials have rejected calls to punish those that refuse to comply, bowing to the wishes of immigrant-rights advocates who say enlisting local law enforcement to report on illegal immigrants they have in their prisons and jails poisons relations with the broader immigrant community.

Montgomery County Police Chief Tom Manger, president of the Major Cities Chiefs Association, said officers should not be asked to enforce immigration laws, since it distracts them from what he said were their more pressing duties.

“Surely no member of the committee would want to hear from their own community that we did not respond to a call for help because we were off enforcing immigration laws,” he chided the Judiciary Committee in his written testimony.

Still, he said cooperating with federal authorities by notifying them of illegal immigrants arrested or about to be released is a good idea — and is the policy of both Montgomery County and the Major Cities Chiefs Association. But he said police departments shouldn’t have federal funding stripped if they refuse to cooperate.

Testimony given by Josh Wilkerson's mother to the Texas State Senate:

Josh's killer had been arrested for beating up his girlfriend months before Josh was murdered.
Had the killer's immigration status been determined, had INS been notified and he been detained and deported, Joshua would be alive today.

Laura Wilkerson speaking today in front of the US Senate:

How many Josh Wilkerson's; How many Kathryn Steinle's; How many Angelica Martinez's; How many 18-year-old Maria Cruiz-Calvillo and her 3-year-old son, Luis Lopez-Cruz's; how many Jamiel Shaw Jr's; how many Elia Margarita Flores'; how many Victor Manuel Garcia's; how many Mirta Rivera's have been beaten, kidnapped, raped, robbed, tortured and/or murdered by people who have no legal right to be here in this country?

How many more will be victims because this country refuses to control its borders and those who are illegally here?

The desire to control the borders is NOT a racist thing. Just look at the list of names that I have given above; it includes victims that were white, black, and hispanic (actually mostly hispanic).

How many more men, women and children will suffer and/or die before this country does something about this?

Agreed.

This whole situation has been actively created by a notable portion of politicians, all the way from the POTUS down to the local level, in the hope that they will gain more political clout for doing so. Even at the expense of public safety, and by willfully circumventing our established laws and their enforcement.

I'm sure that I don't need to mention which US political party is the main perpetrator, although there are a few in the other party who are also on the take.

Lake County shooting suspect arraigned, bond set at $10M

Dawn Kendrick, Brandon Simmons and WKYC Staff 11:53 p.m. EDT July 28, 2015

Judge Michael Cicconetti set his bond at $10 million and set Monday for a preliminary hearing.

PAINESVILLE, Ohio -- Alleged shooter Juan Emmanuel Razo was arraigned this afternoon in Painesville Municipal Court.

Judge Michael Cicconetti set his bond at $10 million and set Monday for a preliminary hearing.

Razo was charged with attempted murder in the shooting of a woman who was walking on the Greenway Corridor bike path with two children. She was shot in the left arm and was treated at TriPoint Medical Center.

Prosecutors and the Lake County Sheriff's Office said at the arraignment that they are expecting to further charge Razo with the attempted rape in Concord of a 14-year-old girl, the murder of Margaret "Peggy" Kostelnik in her home on Ravenna Road and with shooting at law enforcement officers when they tried to apprehend him Monday afternoon.

Prosecutors and the sheriff's deputies stated in court that Razo "gave a full confession to deputies."

Razo was represented by a public defender who entered a "not guilty" plea on his behalf.

The sheriff's department also recounted that on July 7, Razo was detained regarding a "suspicious vehicle" incident and that the U.S. Border Patrol agents told sheriff's deputies that he was here illegally from Mexico but border patrol agents refused to arrest him.

Razo could not produce a driver's license, a green card, a birth certificate nor any kind of identification.

"How in the hell do I even know it's him?" Cicconetti said loudly.

When Cicconetti heard what the further charges were likely to be, he remarked "I can't set a bond high enough" and set it at $10 million.

Background

In a news conference Tuesday morning, officials identified the shooter alleged in two shootings that left one woman injured and another woman dead.

Police were called out to the scene on a report of an attempted rape of a 14-year-old girl. The suspect was the girl's uncle, Juan Emmanuel Razo, 35, of Painesville, who now faces an attempted murder charge.

Officials say he has no local criminal record, but his legal status remains in question. They anticipate he will face more charges as the investigation continues.

Peggy Kostelnik, 60, was found dead by her husband inside their home int he 6000 block of Ravenna Road, which is directly behind the Greenway area where another woman was shot in the arm.

A woman, who had two children with her while on the Greenway, was shot in the left arm. She was taken to TriPoint Medical Center for treatment of a gunshot wound to the arm.

Kostelnik worked as an assistant to the mayor for the City of Willoughby.

Razo is being held at the Lake County Jail.

On Monday afternoon, the FBI, Painesville Police, Lake Metroparks rangers, the Lake County Sheriff's Department and other local agencies responded to an area by the Greenway Corridor in the area of state Route 84 and Liberty Street/Ravenna Road Monday.

In a statement Concord Township officials released Monday night, residents were told:

"Residents should know that the danger is over and they may resume their normal activities."

Just before 5 p.m. Monday, WKYC's crew watched as Painesville police officers -- with guns drawn -- were headed into the Metroparks at the intersection of SR 84 and Liberty Street.

The Concord Fire Department tells WKYC that the woman on the Greenway was taken to TriPoint Medical Center in Concord with a gunshot wound to the left arm.

WKYC's Dawn Kendrick was at the scene and says that the woman told authorities that she heard gunshots and screamed, "Don't shoot, don't shoot, I have kids."

Neither of the children were hurt.

The Greenway Corridor is a 4.8-mile paved trail links the municipalities of Painesville, Painesville Township and Concord Township allowing visitors to enjoy the natural beauty of these communities.

The southern end of the trail connects the Greenway Corridor with The Maple Highlands Trail to Chardon.

Yes, you can safely resume your normal daily activities knowing that the Border Patrol is doing its job.

RIP Peggy Kostelnik. Condolensces to her family, sympathy to the the woman who was shot in the arm in front of her own children, and also to the 14 yr old girl that was raped.

And to think that none of this might have happened had the Border Patrol picked this guy up on July 7th from local law enforcement when he was first apprehended on July 7th.

From another article regarding this Lake County shooting:

Quote:
In response to a request for information, Customs and Border Protection spokesman Jaime Ruiz issued a statement that said, "we're looking at the facts of the case to find out exactly what happened."

Khaalid Walls, a spokesman for Immigration and Customs Enforcement, said the agency "intends to take custody of [Razo] and pursue his removal from the United States."

Oh great, NOW the Border Patrol decides that they want to take custody of him and deport him.

Ok, so this guy was a legal immigrant.

The man accused of killing two Good Samaritans who tried to help him on a Montana roadside was encountered by immigration authorities earlier this year after a burglary arrest, but was unable to be deported because he had already gotten legal status, federal authorities said this week.

[snip]

Jesus Yeizon Deniz Mendoza, an 18-year-old Mexican man, has been charged with the killing of Jason and Tana Shane, who saw him stopped on the side of the road Wednesday and tried to help him. When they showed up on the scene with their daughter, Mr. Deniz pointed a gun at them and demanded money, according to an FBI affidavit filed in the federal court case

They Shanes said they didn’t have any money and Mr. Deniz started to walk away, but then changed his mind and shot the father, then the mother and then the daughter, who was by this time running away. She managed to escape, though not before being shot in the back, the FBI affidavit said.

Mr. Deniz told the FBI he shot the three people with a .22 caliber rifle because he was tired of waiting, and because he thought he heard the daughter laughing at him, FBI Special Agent Larry J. McGrail II said in the affidavit.

Mr. Deniz is Mexican, and the Obama administration deems him a legal permanent resident who entered the country legally on May 31, 2013 — though they didn’t say how he earned that status initially.

It apparently started as a gesture of help to someone in need, with a Montana couple and their daughter stopping on the side of a road to assist a man who was stranded.

But the authorities said that the encounter soon turned deadly. The stranded man fatally shot the couple and injured their daughter because he was “tired of waiting” and the daughter had “laughed at him.”

Those were the words that the suspect, identified as Jesus Deniz, 18, of Wyoming, used when he spoke to F.B.I. officials investigating the killing near the small town of Pryor, Mont., on Wednesday, according to a criminal complaint filed in court.

On Friday, Mr. Deniz was scheduled for an initial appearance at Federal District Court in Billings.

According to reports, one of the victims, identified as Tana Shane, who was in her 40s, initially drove past Mr. Deniz near the family’s home on Wednesday morning and then returned with her husband, Jason Shane, who was in his 50s, and their daughter, Jorah, who is in her 20s, to help him. Family members provided the names to The Associated Press and The Billings Gazette.

The reports quoted Tana Shane’s sister, Ada, as recounting what her niece told her about the attack from the hospital.

After the family returned to his vehicle, Mr. Deniz pulled out a .22 caliber rifle and ordered them to hand over money and their car, according to the complaint. The Shanes, members of the Crow Indian tribe, said they had only change.

When he told them to start walking, Tana Shane told her daughter in their native language to run, and she did, the complaint said. Gunshots rang out. The Shanes were killed, and their daughter was grazed in the head by a bullet. She also had a gunshot wound in her back.

Was this guy one of those "Dreamers"?

Wait a minute.....I know that generally, once you have gained citizenship, deportation back to your prior country is very unlikely, but I was under the impression that "legal status but not yet a citizen" still allows deportation. Isn't citizenship usually contingent (or at least used to be) on having a clear criminal record? So if you are legal (but not a citizen) and commit a criminal offense, shouldn't that place your legal status in jeopardy?

RIP to two more people (in this case Native Americans) and a speedy recovery to the daughter that was shot in the head and in the back. all because this POS was “tired of waiting” and the daughter had “laughed at him.”

An illegal immigrant from Mexico has admitted to strangling a 30-year-old New Jersey woman he worked with, and setting her body and house on fire to cover up the crime.

Juan Jimenez-Olivera, 30, pleaded guilty Wednesday to murder, aggravated arson, desecrating human remains, theft and related offenses in the slaying of Sviatlana Dranko, his co-worker at a pizzeria.

Jimenez-Olivera admitted in court to strangling Dranko in April 2014 in her Hillsborough home, stealing $6,000 and lying to police about his involvement before turning himself in two days later.

Guilty: Juan Jimenez-Olivera (left), an illegal immigrant from Mexico, has pleaded guilty to murder, aggravated arson, desecrating human remains and related counts in the slaying of Sviatlana Dranko (right)

Prosecutors say he put a pillow case over Dranko's face and used a lighter to start the blaze.

In exchange for his guilty pleas, the state has agreed to drop a first-degree aggravated sexual assault charge and recommend a 30-year sentence without the possibility of parole on the murder count.

The defendant is facing an additional five-year sentence, to be served consecutively, for desecrating the victim’s remains, according to NJ.com.

The Hillsborough man is in the country illegally and a judge says he could be deported.

Jimenez-Olivera remains in the Somerset County Jail pending his September 18 sentencing. His $1million bail has been revoked.

On April 29, 2014, at 8.23am, police and firefighters from multiple departments responded to Dranko's home in Bloomingdale Drive in response to calls about a fire.

Upon entering the house, first responders found Dranko dead with severe burns to her body inside a second-floor bedroom.

An investigation later determined that Dranko was dead before the fire ignited.

Jimenez-Olivera was arrested two days later after turning himself in and charged in Dranko's death.

Detectives said the two did not have a romantic relationship and were only workplace acquaintances.

Danko's sister and her husband were in court Wednesday to hear Jimenz-Olivera's confession.

Brian Hyde Charged With Triple Homicide in Lehigh Acres, Florida

by SHAMAR WALTERS

AUG 14 2015, 6:55 AM ET

A teenager from Belize has been charged with murdering three people — including his pregnant cousin — in an "extremely violent" attack in Florida, officials said Thursday.

The Lee County Sheriff's Office said deputies responding to a medical assistance call on Tuesday found three dead bodies inside a home in Lehigh Acres, about 12 miles east of Fort Myers. An 18-month-old child was found alive.

The deceased — identified as 37-year-old Dorla Pitts, her pregnant 17-year-old daughter Starlett Pitts and the girl's boyfriend Michael Kelly Jr., 19 — had suffered "repeated, sharp force trauma," according to the sheriff's Office.

It said that while processing the "extremely violent" and bloody crime scene, detectives learned that 19-year old Brian Omar Hyde had been pulled over by Fort Myers police for driving on the wrong side of the road.

Hyde was in a white Range Rover registered to the same address as the crime scene and had "visible blood" on his pants and shoes, the sheriff's office said.

The 19-year-old — Dorla Pitts' nephew — was arrested for driving without a license and later charged with murder after investigators found more evidence linking him to the scene.

The sheriff's office said that a bloody palm print at the crime scene was a match for Hyde and that investigators believe Dorla Pitt walked in as the attack was in progress because her husband told detectives he was on the phone with her when she screamed "Brian! What happened here!" before the line went dead.

Hyde — who officials say illegally entered the United States from Belize about seven months ago — is facing three counts of second degree murder and one count of killing an unborn child by injury to the mother.

Kate Steinle’s parents file legal claims against San Francisco, federal officials, in pier shooting death

BY DEBORAH HASTINGS , RACHELLE BLIDNER NEW YORK DAILY NEWS Updated: Tuesday, September 1, 2015, 4:10 PM

Kate Steinle's parents announced Tuesday they had filed legal claims against San Francisco and federal officials in connection to their daughter’s death, which sparked fierce national debate about immigration policies.

"We're here not only for Kate, we're here for every citizen of this country who comes to San Francisco," said Jim Steinle, Kate's father. "If you think this can't happen to you, think again.

Speaking to acrowd of reporters, Jim and his wife, Liz Sullivan, were joined by their son, Brad Steinle. The family said it had filed claims against San Francisco Sheriff Ross Mirkarimi, the U.S. Immigration and Customs Enforcement and the U.S. Bureau of Land Management, whose stolen gun was used in the shooting, the San Jose Mercury News reported.

Kate Steinle was shot to death while going on a stroll with her dad at Pier 14 on July 1. She died in her father's arms.

"She said 'help me, help me.' That's my bedtime story every night," her dad said.

Family attorney Frank Pitrie said "What happened on Pier 14 was not only forseeable, it was preventable."

Katie's mother told reporters "This is for accountabiliity for public officials that we have voter for, who are not doing their job."

Her alleged killer, Juan Francisco Lopez-Sanchez, a 45-year-old Mexican national, had been deported five times for multiple felonies. He had been held in a San Francisco jail in April and released when the charges were dropped because of the city's "sanctuary laws."

Sheriff Mirkarimi should have notified ICE when Lopez-Sanchez was released from jail, the Steinle family says.

His attorney said the shooting was accidental -- he found the .40-caliber gun on the pier by his feet and it accidentally went off. The firearm had been stolen from a Bureau of Land Management ranger during a car break-in in June.

Steinle's death prompted presidential candidates like Donald Trump and Hillary Clinton to weigh in on immigration reform. Her parents have been outspoken about the need for change, calling on legislative action at a senate judiciary hearing in July.
